摘要：The application of criminal law should be the last response of society to a criminal offense and also must have a re-educational counseling, restorative and resocialization. Despite the rehabilitation and social reintegration are not the only purpose of punishment and its execution and therefore be explored and analyzed all purposes under applicable law. This shows a series of contradictions so that, the undeniable prison reform, there was once accompanied by a parallel transformation of nineteenth-century penal system. In this report a critical analysis of the purposes of the Criminal Law and Prison Law and lege ferenda proposals on the necessary revision thereof.
