摘要：Este artigo trata das audiências públicas da Lei Orçamentária Anual (LOA) realizadas pela Assembleia Legislativa do Espírito Santo, no período de 2007 até 2014. O tema central é a efetividade da participação das audiências, ancorada em duas dimensões: o momento deliberativo e os resultados das audiências para o orçamento. Partimos do pressuposto que, apesar da dificuldade de mensurar efeitos práticos, instituições participativas, tais como as audiências da LOA, atuam para aprofundar a democracia, destinando recursos públicos de acordo com demandas da sociedade civil. O artigo analisa elementos constituintes das audiências (formato institucional, perfil dos legisladores, perfil dos participantes, relação Executivo-Legislativo e as emendas parlamentares) para avaliar a efetividade dessa participação. Utilizamos uma abordagem multimétodo com a combinação de três ferramentas de pesquisa: análise documental (relatórios da LOA, legislações e vídeos das audiências públicas), survey (aplicado aos participantes das audiências de 2014) e entrevista semiestruturada (com os parlamentares que fazem parte da Comissão de Finanças). A análise aponta para a pouca efetividade das audiências a partir da combinação de vários fatores, entre eles a baixa institucionalização, o perfil dos participantes, a influência do poder Executivo no processo a partir de sua relação com os parlamentares e o uso das emendas parlamentares como estratégia eleitoral. O estudo apresenta uma alternativa metodológica para avaliar a efetividade da participação a partir da interação entre os fatores endógenos e exógenos, que inclui a relação Executivo-Legislativo.
其他摘要：This research is a study about Annual Budget Law (Lei Orçamentaria Anual – LOA) of public hearings performed by Assembleia Legislativa do Espirito Santo from 2007 until 2014. The main purpose of this work is the effectiveness of public hearings participation, anchored in two dimensions: the deliberative moment and the hearings results. We assume that, despite the difficulty of measuring practical effects, Participatory Institutions such as the LOA public hearings, act in a way of intensifying democracy, especially in the al - location of resources according to the demands of civil society. In this perspective, this research analyzes public hearings components (legislators profile, institutional design, participants profile, Executive-Legislative relations and parliamentarian amendments) to eval - uate the participation effectiveness. For this analysis, we used multi method approach combining three research tools: document anal - ysis (LOA reports, laws and public hearings videos), survey (applied to the participants of the hearings of 2014) and semi structured interview (with Finance Committee parliamentarians). The analysis points to the low effectiveness of the audience as result of the combination of several factors, including low institutionalization, the profile of the participants, the Government influence in the process because of the relationship with the parliamentarians and using parliamentarian amendments as an electoral strategy. The study pres - ents a methodological alternative to evaluate the effectiveness of participation from the interaction between the endogenous and exogenous factors, which includes the executive-legislative relationship. The approach made it possible to examine the effectiveness of the participation in two directions whether the effectiveness of the deliberation or of the results in the budget.
