摘要:This article tries to discuss the legal status of transnational corporations (TNC) under international law (IL). The work focuses on two developments of the proposed problem. First, it presents the different links made between the idea of international legal subjectivity and international legal personality, taking as its starting point the subject-object dichotomy. Second, discusses whether the TNC are able or not to meet the criteria of Bernadotte Case and of the traditional doctrine of IL. This article concludes that the TNC are de facto subjects of IL, arguing that these entities are able to have rights and obligations under IL; participate in the law-making process and in international dispute resolution.
