摘要：: This study aims at analyzing the decision of the Federal Supreme Court according to which the criminalization of abortion is unconstitutional in the hypothesis of voluntary interruption of pregnancy in the first trimester. A summary of the factual aspects of the case and the normative grounds of the decision is presented. In the end, a critical assessment of the normative foundations adopted by the Federal Supreme Court and considerations about the consequences in the plan judicial and political are made.
