摘要：El artículo da cuenta de algunas experiencias novedosas respecto de la "mediaciónreparación" entre la víctima y el infractor, en el marco de las tendencias actuales de la justicia restauradora. Asimismo, aborda la cuestión del origen de esta forma de justicia, sus notas características, las dificultades y tensiones que implican los principios que la inspiran, las críticas teóricas y las evaluaciones empíricas de que han sido objeto los rasgos y programas que la concretan, y las condiciones mínimas que deberían reunir esos programas de justicia restauradora para merecer un tal calificativo. Finalmente, en el texto se defienden los valores -positivos- de esta forma de justicia y se aboga por una discusión razonable acerca de en qué casos es posible; pero se advierte también sobre los riesgos de la indiferencia institucional y social frente al tema, de la resistencia a toda experiencia novedosa, y deja extensión de la red penal.
其他摘要：The article gives a report of some new experiences related to "mediation-reparation' between the victim and the infractor, in the context of actual tendences of restorer justice. Likewise talks about the origin of this forrn of justice, its characteristic notes, the difficulties and tensions that involve the principies that inspire it, the theoretical critics and empírical evaluations made of the characteristics and programs that concrete ir, and the minimum conditions that should gather those restorer justice programs to achieve such name. Finally, the text defends the -positive- values ofthis form of justice and claims for a discusión about in witch cases is possible; but it also takes notice about the risk of the institutional and social indifference about the subject, of the resistance to every new experience, and extension of penal system.
