摘要：Hukukun başlıca sorunları olan genellik ve geçerlilik Immanuel Kant’ın evrensel yasa arayışını incelemeyi gerektirmektedir. Kant evrensel ilkeleri ararken hukuka dair belirlemeler yapmaktadır. Bu çalışmada hak ve hukuk kavramları Kant’ın kapsayıcı ve bütünleştirici sisteminde tahlil edilmektedir. Ahlak Metafiziği’nin Temellendirilmesi (1785) eserinde temeller görülürken Ahlak Metafiziği (1797) eserinde hakka ve yasal düzenlere dair bir doktrin kurulmaktadır. Kant’ın ideal sisteminde yasal mevzuat değil yasaların temellendiği ilkelerin belirlenmesi esastır. Bu belirleme aynen ahlak yasasında olduğu gibi sonuçlarla ilgilenmez. Bir eylemin sonucunun iyi olup olmaması sorun teşkil etmez. Eylemin dayandığı ilkenin iyi olması, dolayısıyla hukuki açıdan da eylemin dayandığı yasanın iyi olması gerekir. Böyle bir yasanın olanağı da Kantçı metinlerin çözümlenmesi ile izah edilebilir.
其他摘要：Main problems of law, generality and validity requires studying on Immanuel Kant’s search of universal law. Searching the universal principles, Kant makes statements about law. In this study right and law are analysed in Kant’s inclusive and integrative system. In his Groundwork for Metaphysics of Morals (1785) fundamentals are observed and in Metaphysics of Morals (1785) a doctrine is established about rights and legal systems. In Kant’s ideal system, it is essential to determine basic principles on which laws are based, not legislation. This determination, likewise the moral law, doesn’t pay attention to consequences of actions. It’s not an issue, whether outcome of the action is good or not. What is important that the principle the action relies onto needs to be good so does the law that action relies onto. Thus, possibility of a law like this can be explained through analysing the Kantian texts.
