摘要:Falsification of documents does not only happenin civil courts. Shariah courts also face the sameproblems despite being ‘religiously’-orientedcourts. It can be argued that, in the case ofMalaysia, civil courts have clearer guidelinesregarding the authentication of documentscompared to Shariah courts. This study utiliseda questionnaire survey as well as interviewsin collecting data to measure the perceptionsand opinions of relevant respondents withvarious stake holdings from those who practicelaw, with a Shariah and civil background. Itshould be noted that the key informants werecomprised of forensic experts Shariah and civilpractitioners. Analysis of the collected dataindicates that the necessity of forming a legalforensic model is supported by the majority ofthe participants, which, therefore, implies that aforensic model that makes the authentication ofdocuments more structured, clear and practicalmust be formed in Shariah courts. The practiceof civil courts in relation to the authenticationof documents should be used as a model inShariah courts so long as they comply with theprinciples of Islamic law.
