摘要：Dentre os instrumentos constitucionais de garantia cidadã, o Mandado de Injunção permanecia, até pouco tempo atrás, sem regulamentação legislativa. A omissão legislativa não impediu que a cidadania se apropriasse do instituto e o utilizasse largamente para demandar ao Judiciário a concretização de direitos fundamentais. Depois de um lento processo de consolidação, foi criada, em 2016, a lei do mandado de injunção. Contudo, diante das teorias que pugnam por um retorno da soberania popular aos debates constitucionais, em especial o constitucionalismo popular e o constitucionalismo democrático, e as teorias dialógicas que indicam o necessário debate entre as diversas instituições e poderes, cabe indagar sobre a necessária abertura procedimental do mandado de injunção às fórmulas de participação popular na jurisdição constitucional. A partir desta concepção teórica, o objetivo do artigo é examinar o Mandado de Injunção, utilizando-se de pesquisa documental, jurisprudencial e de revisão bibliográfica no campo do direito constitucional.
