摘要：در مقطع کنونی و با التفات به پیشرفتهای علم پزشکی، مقوله حمایت از سلامت جنین بیش از هر زمان دیگری مطمحنظر کنشگران عرصه سلامت و تقنین قرار گرفته است؛ به این مناسبت، جنینآزاری صرفاً در قالب خشونت فیزیکی جای نمیگیرد و بلکه بسیاری از رفتارهای خطرسازی که در دوران بارداری از جانب فرد حامل جنین صورت میگیرد را شامل میشود که حسبمورد زمینه بروز مرگ، بیماریها و نارساییهای جنینی را فراهم میآورد. در این مسیر، ایالات متحده آمریکا به موازات جرمانگاری نسبی سقط جنین، حمایت کیفری شایستهای را در قبال سایر آزارهای وارده به جنین آن هم تحت عنوان حمایت از کودکان متولدنشده، انجام داده است. این موضوع علاوه بر سطح فدرال حتی در برخی از ایالات همچون کارولینای جنوبی مورد اهتمام بیشتری نیز واقع شده است. با این مراتب، سیستم کیفری ملّی اگرچه در قوانین مجازات اسلامی و تعزیرات رویکرد حمایتی را نسبت به خشونت علیه جنین مبذول نموده است لیکن در حوزه جنینآزاری ناشی از غفلت یا قصور واکنش قابلی را از خود نشان نداده است. به همین روی در این پژوهش قصد بر آن است تا با تحلیل و مقایسه وضعیت جنینآزاری در سامانه کیفری آمریکا و ایران به ترسیم راهبرد حمایتی مغتنمی پرداخته گردد.
其他摘要：Today and with the advancement of medical science, the issue of protecting the health of the fetus has become more and more of a concern for actors in the field of health and legislation. On this occasion, fetal abuse is not limited to physical violence that causes abortion or damage to their members. Rather, it includes many of the risk behaviors that a pregnant woman during pregnancy can provide for the incidence of death, fetal illnesses, and fetal disorders. In this regard, the United States has, along with the relative ban on abortion, has provided suitable criminal protection against other abuse to the fetus, also known as the protection of unborn children. In addition to the federal area, this issue has been further targeted in some states like South Carolina. In this regard, the national criminal justice system, although in the Islamic Penal Code and Tacitus, has provided a supportive approach to violence against the fetus, but has not responded to the fetal neglect or failure. Therefore, in this study, the aim of this study is to provide a supportive strategy by analyzing and comparing the fetal abuse status in the criminal system of the United States and Iran.
