摘要：El presente trabajo analiza la situación de los pactos de indemnizaciones convencionales en contratos de trabajo, en los que se acuerda no aplicar el límite de UF 90 sobre la base de cálculo de la indemnización por años de servicio. Se revisarán dos problemas de relevancia dogmática y práctica relacionados con dichos pactos. El primero, se refiere a aquellas cláusulas donde se establece que la base de cálculo será la “última remuneración mensual”, sin mención explícita al tope de UF 90. El segundo dice relación con pactos que establecen una indemnización sin el tope indicado, donde se estipula que ésta sólo se devengará si el contrato finaliza por las causales de necesidades de la empresa o desahucio (art. 161 Código del Trabajo). Aquí surge la inquietud acerca de si el trabajador puede reclamar igualmente dicha indemnización, si es despedido por otra causal de forma injustificada.
其他摘要：This paper analyzes conventional compensation agreements in labor contracts, in which the legal cap of UF 90 is not applied for the basis of calculating the indemnity for years of service. In particular, the article reviews two problems of dogmatic and practical relevance related to such agreements. The first one refers to those clauses which state that the basis for calculation will be the “last monthly remuneration”, without explicitly mentioning the UF 90 cap. The second one relates to the agreements that set up an uncapped compensation, that will only accrue if the contract is terminated on the grounds of business needs or dismissal (art. 161 Chilean Labor Code). Under this second type of clause, the question is if the employee can demand the conventional compensation, if he or she is fired on the grounds of another legal hypothesis, but the termination has been deemed unjustified by the Court.
