摘要：O presente artigo utiliza a moderna técnica de interpretação constitucional, uma vez que conflitos como este, não podem ser resolvidos com a utilização da interpretação jurídica tradicional, que se desenvolve através do método subsuntivo das regras ao caso concreto. É que os direitos fundamentais possuem as mesmas características normativas dos princípios, e abrigam em seu bojo valores contrapostos igualmente relevantes. Nesses casos, o intérprete deve ter um papel criativo e mediante a técnica da ponderação de valores ser capaz de aferir o peso de cada um desses direitos fundamentais que estão em jogo, para no final decidir em favor dqauele que melhor se adeque às circunstâncias sociais. Por fim, o artigo analisa a prática da vaquejada, manifestação cultural típica da região Nordeste, demonstrando que o direito fundamental a um meio ambiente equilibrado, livre de práticas que submetam os animais à crueldade (art. 225, VII, CF/88) deve prevalecer em relação ao direito fundamental à livre manifestação cultural, previsto no art. 215, CF/88.
其他摘要：This article uses the modern technique of constitutional interpretation, since conflicts like this can not be solved with the use of traditional legal interpretation, which is developed through the subsonic method of the rules to the concrete case. It is that the fundamental rights have the same normative characteristics of the principles, and they harbor in their bulge equally important opposing values. In such cases, the interpreter must have a creative role and, by means of the value-weighting technique, be able to gauge the weight of each of those fundamental rights that are at stake, in order to decide in favor dqauele that best suits social circumstances. Finally, the article analyzes the practice of vaquejada, a typical cultural manifestation of the Northeast region, demonstrating that the fundamental right to a balanced environment, free from practices that subject animals to cruelty (article 225, VII, CF / 88) must Prevail in relation to the fundamental right to free cultural manifestation, provided for in art. 215, CF / 88.
