摘要：O presente artigo pretende realizar o cotejo entre as disposições do Decreto nº 24.645/34, promulgado no inicio da era Vargas, e reconhecido como a primeira norma que tratou, dentro do contexto da época, a proteção jurídica dos animais, e, o atual do Projeto de Lei do Senado Federal nº. 351/15, de iniciativa do senador Antonio Anastasia que pretende alterar o texto do Código Civil - Lei Federal nº. 10.406, de 10 de janeiro de 2012-, para descaracterizar os animais como coisas- no artigo 82- e incluí-los como bens- no artigo 83.
