摘要：Este artigo investiga a formação dos contratos de arrendamento rural, como instrumento de acesso à terra, enquanto direito fundamental, tomando por base uma perspectiva comparada entre Brasil e Colômbia. Discute-se o ambiente institucional e as motivações que condicionam os arrendamentos, a partir de dados estatísticos e à luz da interpretação sociológica do Direito. O objetivo é discutir como as condicionantes jurídicas e econômicas são insuficientes para compreender a formação dos arrendamentos no contexto da agricultura familiar, bem como a importância dos valores intrínsecos à forma de viver (“habitus”) dessa categoria social, enquanto fator central para a decisão de arrendar.
其他摘要：This article investigates the formation of tenancies contracts in Brazil and Colombia. Using the data of the Census of Agriculture (IBGE, 1995, 2006; Censos/Encuestas Agropecuários colombianos, 1988, 2004), in the light of economic and sociological interpretation of the law, it researches information related to options for lease. The goal is to discuss how legal and economic constraints are insufficient to understand the formation of tenancies in the context of family farming in Brazil and Colombia, as well as the importance of values intrinsic to the way of living and acting (“habitus”) of this social category.
