标题：El cambio del eje referenciador del derecho a la protección de la salud a partir de la jurisprudencia constitucional sobre el subsistema privado de salud
摘要：El presente trabajo analiza la principal jurisprudencia constitucional de tutela del derecho a la protección de la salud en el sub-sistema privado. Se sostiene que en los últimos años, la jurisprudencia del Tribunal Constitucional ha desarrollado un cambio en el eje referenciador en la significación constitucional de este derecho, pasando desde un eje de corte “individual-contractual” a uno en “perspectiva social”. Se transita desde una regulación contractual privada bajo parámetros constitucionales a una conceptualización como un derecho social, con base en la dignidad, el efecto irradiativo de los derechos fundamentales a la relaciones privadas y el carácter de orden público de los contratos. El nuevo eje se compone por la consideración del derecho a la protección de la salud como un derecho integrado al sistema de seguridad social y ligado al principio de igualdad, estando excluida toda discriminación arbitraria en el acceso y goce del derecho.
其他摘要：This paper analyses the main constitutional case law on the safeguarding of the right to health protection in the private sub-system. It is stated that on the last years, the case law of the Constitutional Court has developed a change on the axis of reference in the constitutional meaning of this right, moving from an “individualistic/contractual” one to one on “social perspective”, where health, from a private contract regulation under constitutional parameters ; is conceptualized as a social right, based on dignity, the irradiation effect of fundamental rights towards private relations and the public order character of contracts; and comprising by the consideration of the right to health protection as a right integrated to the Social Security system and linked to the principle of equality, being excluded of any arbitrary discrimination on the access and enjoyment of the right.
