摘要：RESUMO: O artigo realiza uma análise crítica sobre a questão da judicialização das políticas públicas que versam sobre o direito à saúde. Para tanto, será feita revisão da literatura com a finalidade de demonstrar as correntes doutrinárias sobre as possibilidades de fruição de tal direito, bem como será feita uma análise crítica dos precedentes do Supremo Tribunal Federal dos últimos 05 anos sobre a questão da judicialização desse direito fundamental. Ao final, será demonstrado que o direito à saúde gera ao cidadão o direito subjetivo de pleitear, de maneira imediata, o custeio de um tratamento médico, bem como fornecimento de determinado medicamento, de acordo com a Teoria da Justiça Distributiva de John Rawls.
其他摘要：The article presents a critical analysis on the issue of legalization of public policies that deal with the right to health. For this, the literature review in order to demonstrate the doctrinal trends of the possibilities for enjoyment of such rights will be made, as well as a critical analysis of precedents of the Supreme Court of the last 05 years on the issue of legalization of this fundamental right will be. At the end, it will be shown that the right to health generates the citizen’s subjective right of audience immediately, the cost of medical treatment, as well as providing certain drug, according to the Theory of Distributive Justice by John Rawls.
