摘要：Sabemos que vivimos en tiempos de profundos y permanentes cambios y, si en un ámbitose resalta esa diferencia, es precisamente en el derecho de familias. Es previsible quemuchas de las prácticas médicas y sociales se transformen radicalmente comoconsecuencia de estos avances. Este progreso y transformación de la ciencia médica haplanteado una multitud de problemas, no sólo en el derecho sino también en la ética,muchos de los cuales hace unos años hubieran sido insospechados. Por ejemplo, podemospensar en el trasplante de órganos, las clonaciones, y lo que aquí interesa, gestación porsustitución. El desafío de este trabajo es presentar ciertos argumentos ético-jurídicosdesde la filosofía moral en cuanto a la gestación por sustitución. Lo interesante es saberque de esta revolución científica no escapa nuestro derecho.
其他摘要：We know that we live in times of deep and permanent change and this situation isparticularly flagrant in Family Law. It is foreseeable that many medical and socialprocedures will evolve because of these changes. And this progress and transformationthat have been taking place in the Medical Sciences poses multiple problems not only toLaw, but also to Ethics—and most of these problems were unthinkable a few years ago—,e.g. organ transplantation, human cloning and surrogacy. In this article, I will focus on thelatter with the aim of presenting legal and ethical foundations of surrogacy, particularlythrough the lens of moral theory.
