摘要：El estatus de los animales ha ido modificándose conforme la ciencia nos ha demostrado su capacidad para sentir y sufrir y según han pasado a ocupar un lugar (no solo instrumental) en el espacio social que compartimos. Sin embargo, se siguen sucediendo situaciones de maltrato y abandono que por su dureza y gravedad se han tipificado en el Código penal y se han seguido de un castigo que deberá ser proporcionado y eficaz. Ahora bien, para que el castigo logre algún efecto preventivo y se evite la reincidencia de los agresores o la delincuencia de quienes podrían serlo tenemos que analizar las penas previstas en la legislación penal para reforzar estos delitos y, en su caso, proponer otras que, a la postre, logren prevenir eficazmente situaciones de sufrimiento de los animales y mejore su bienestar.
其他摘要：The status of animals has been modified as science has shown us their ability to feel and suffer and as they have come to occupy a place (not only instrumental) in the social space we share. However, situations of abuse and neglect continue to occur which, due to their harshness and seriousness, have been considered susceptible to be defined in the Criminal Code and followed by a punishment that must be proportionate and effective. Now, in order for punishment to have some preventive effect and to avoid the recurrence of aggressors or the delinquency of those who could be, we have to analyze the penalties provided for in the penal legislation to punish these crimes and, if appropriate, propose others that, in the end, they manage to prevent animal suffering situations and improve their welfare.
