摘要：Teniendo como parámetro el Sistema Interamericano mediante un estudio comparado, se analiza la situación jurisprudencial que guarda el derecho a la salud en dos de los países más representativos de América Latina: México y Colombia, a partir del estudio de los criterios emitidos por la Suprema Corte de Justicia de la Nación y los tribunales federales, en el primer caso, y del actuar de la Corte Constitucional Colombiana, en el segundo, con el propósito de contrastar los avances y limitaciones que se han tenido en la materia y vislumbrar la tendencia garantista colombiana como un referente para superar las limitaciones que enfrenta el derecho a la salud en México.
其他摘要：Taking the Inter-American System as a standard, through a comparative study, this article analyzes the jurisprudential state that protects the right to health in two of the most representative countries in Latin America: Mexico and Colombia based on the study of the criteria issued. by the Supreme Court of Justice of the Nation and the federal courts. In the first case, the actions of the Colombian Constitutional Court, in the second case, contrasts the advances and limitations that have taken place in health matters and to provide a glimpse the Colombian guarantee trend as a reference to overcome the limitations that Mexico might encounter in health matters.
