摘要：A partir de la reconfiguración de determinados paradigmas y la incorporación de nuevas categorías se ha operado una interesante metamorfosis en el Derecho Civil. El presente trabajo se propone insistir en la potencialidad de los principios e incluso allí donde la imperatividad de la materia es obligada a ceder ante la ante la voluntad del justiciable.
