摘要：Ante la necesidad de brindar soluciones, el Código Civil y Comercial remite a la opinión de los propios sujetos involucrados en la controversia. En el presente estudio analizamos la cuestión sosteniendo que el cuerpo legal se apoya en una ética procedimentalista basada en el discurso y en la reflexión.
