摘要：En el debate actual sobre el constitucionalismo surgen cuestiones que han permanecido a través del tiempo en la Filosofía del Derecho; a saber: el iusnaturalismo y el iuspositivismo. Estos elementos han permitido plantear nuevamente la naturaleza y orientación de la Teoría Constitucional y la manera cómo se aplica en los Estados Constitucionalistas; dando paso a lo que se ha denominado Neoconstitucionalismo; esto ha generado que el valor del componente positivo de la Norma no sea el centro único del componente jurídico; sino que elementos como la ponderación y el Tribunal Constitucional; que hacen parte de una reflexión axiológica e iusnaturalista; tengan parte en dicha comprensión. De esta manera; se evidencia que la reflexión sobre la Constitución hace parte de una discusión actual y que está en constante construcción.
其他摘要：Within the modern debate of constitutionalism are brought concepts that have remained through the time around the Philosophy of Law, they are known as: legal naturalism and legal positivism. Those ideologies have allowed making a restatement of the nature and orientation of the Constitutional Theory and the way how it is applied in Constitutional States, hence opening the road to the so called New Constitutionalism. Therefore, this has changed the reading of the Constitution for the positive component of the rule is no longer the center of the legal law; furthermore, new elements such as the Constitutional Tribunal and the Weight formula have been introduced in order to make an axiological and legal naturalistic thinking of the law. Thus, it is shown how the reading of the Constitution plays a key role in modern issues, although it is still under construction.
