摘要：La Nueva Codificación procesal, incluyó como figura innovadora, la del Proceso bautizado como Monitorio, que implica en favor del acreedor, la posibilidad de reclamación de su acreencia, cuandoquiera que no posee título alguno en donde conste o pueda llegar a constar la deuda que se tiene para con él. Si bien es cierto, la figura pretende darle aires nuevos a la legislación procedimental, nuestro país se hallaba en mora de su inclusión y reconocimiento en el Derecho Positivo. Legislaciones foráneas europeas y americanas, dan cuenta de los positivos alcances y resultados que arroja a nivel judicial, la implementación de figuras que bajo nombres diversos, consagran derechos en favor de los acreedores desprovistos de títulos en los cuáles fundamentar su acreencia. El tiempo, indicará sin lugar a dudas, las bondades o desaciertos de su tipificación en el Código General del Proceso.

Although it is true, the figure aims to give new airs to the procedural legislation, our country was in arrears of its inclusion and recognition in the Positive Law. European and American foreign legislations show the positive reaches and results at the judicial level, the implementation of figures who, under different names, dedicate rights in favor of creditors without titles on which to base their credit. Time will indicate without doubt, the benefits or errors of its typification in the General Code of the Process.
