摘要：La acción de tutela es la acción constitucional por excelencia, ya que por sus características se convierte en el principal instrumento de la población para reclamar sus derechos fundamentales. Por ello es de vital importancia entender cómo opera el derecho procesal constitucional, como una construcción jurídica que funciona a través del intérprete constitucional y se erige como un derecho constitucional “concretizado”. Así, los autores abordan en este trabajo las características de la acción de tutela –entre las cuales incluyen objeto, legitimación, trámite judicial y fallo–, advirtiendo que debe distinguirse entre el trámite de la tutela en la Corte Constitucional y el trámite en los juzgados y tribunales del país.
其他摘要：The action of tutela is the constitutional action by excellence, by its characteristics it becomes the main instrument of the population to claim their fundamental rights, which it is of vital importance to understand how constitutional procedural law operates, as a legal construction that works through the constitutional interpreter and stands as a constitutional right “concretized”. So, we bring in this work the characteristics of the action of tutela, including object, legitimation, judicial process and the judgment. Warning from the outset, that should be distinguished between, the process of tutela in the Constitutional Court and in the tribunal and courts.
