摘要：En este artículo de investigación se estudian las implicaciones de la teoría constructivista, en referencia al concepto de racionalidad jurídica en Niklas Luhmann; se parte de las consideraciones realizadas por Niklas Luhmann en la teoría de los sistemas autopoiéticos, con la disposición de difundir una posición crítica frente a las implicaciones que se crean al momento de aplicar los concepto Luhmannianos en la racionalidad jurídica.
