摘要：El objeto de este trabajo es determinar cuál es la responsabilidad patrimonial del adquirente del inmueble sujeto a régimen de Propiedad Horizontal por las cantidades adeudadas para el sostenimiento de los gastos generales por el antiguo propietario y cómo exigir la responsabilidad derivada de este incumplimiento ante los tribunales. Para ello, analizaremos el significado y la naturaleza de la figura jurídica de la “afección real” del inmueble prevista por el legislador en el art. 9.1.3, letra e), de la LPH y a la luz de este análisis, estudiaremos cuál sería, de entre los previstos en nuestro ordenamiento jurídico, el procedimiento idóneo ante los tribunales para hacer valer dicha afección real y cuáles son los problemas de naturaleza registral que impedirían la inscripción de la preferencia del crédito que ostenta la comunidad de propietarios frente a otros acreedores anteriores.
其他摘要：The purpose of this paper is to determine the financial liability of the purchaser of the property subject to the Horizontal Property regime for the amounts owed for the support of general expenses by the former owner, and which would be the ideal procedure to demand this type of liability before the courts. In order to address this question, we will analyse the meaning and nature of the legal form of the 'real damage' to the property provided for in Article 9.1.3 e) of the LPH and, in the light of this analysis, we will study among the procedures provided for in our legal system, which would be the best way to assert this real damage in court and what the registration problems would be that would prevent the registration of the preference of the Community claim against other previous creditors.
