摘要：Foi nossa proposta desenvolver nesse artigo uma abordagem crítica sobre o fenômeno de Constitucionalização dos Direitos Fundamentais, especialmente no tocante às transformações e rupturas promovidas pela irradiação dos valores constitucionais a todo o ordenamento jurídico. Observamos que a Constitucionalização dos Direitos Fundamentais se aproximou da Filosofia contemporânea propondo, através de teses antipositivistas, uma hermenêutica constitucional capaz de (re)aproximar o Direito da Moral, com vistas à promoção de justiça material, com o protagonismo do Poder Judiciário. Entretanto, constatamos também os impactos causados por essas teses identificando algumas dificuldades a serem enfrentadas, tais como: a segurança jurídica; a possibilidade de decisões particularistas e o desafio na construção de uma tese moral de validade universal.
其他摘要：Our proposal aims to ensure a critical approach about this phenomenon referred as Constitutionalization of Fundamental Rights, especially with regard to changes and breaks promoted by the radiation of the constitutional values through the whole legal framework. We observe that Constitutionalization of Fundamental Rights approached the contemporary philosophy through constitutional hermeneutics, seeking a rapprochement between law and moral, with a view to promoting material justice. However, observing the impact of these theses, we found some difficulties to be faced such as: legal certainty; the possibility of particularistic decisions; and the challenge of building a universal validity moral thesis.
