摘要：Las funciones de la Armada Argentina y la Prefectura Naval Argentina se encuentran ordenadas y delimitadas jurídicamente por la legislación vigente en el país. Si bien esta legislación asigna a las Fuerzas Armadas la misión principal de conjurar y repeler las agresiones estatales militares externas (AEME) y, por lo tanto, es la Armada Argentina quien debe ejercer el control de los espacios marítimos, cabe discernir quién debe realizar interdicciones sobre navíos intrusos (NAI) que no suponen una AEME. En esta definición se superponen criterios tales como la naturaleza del problema a enfrentar, la legislación internacional y nacional, como así también la asignación de recursos del Estado Nacional para dar cuenta de la problemática de los NAI en el mar argentino. En este sentido, el presente artículo reseña brevemente cuáles son los espacios marítimos involucrados, los instrumentos internacionales y nacionales de referencia y los rasgos distintivos en su interpretación por parte de ambas Fuerzas en Argentina.
其他摘要：The demarcation of functions between the Navy and the Coast Guard in Argentina are legally mandated by the legislation in force in the country. While this legislation assigns to the military ‘s primary mission to avert and repel external state’s military aggressions and, therefore, being the Argentinean Navy who must have control of maritime areas, it must discern who perform bans on ships intruders (NAI) that are not coming from an external state military aggression. In this definition, different criteria such as the nature of the problem facing, the international and national legislation, as well as the allocation of resources of the National State, are overlaped to account for the problem of NAI in the Argentinean Sea. In that sense, this article presents what are the maritime areas involved and a brie y review of the international and national reference tools as well as the distinctive features in the interpretation that the Argentinean forces make about the legislation.
