摘要：El artículo describe que el derecho sancionador castrense deriva de la regulación constitucional del monopolio de la fuerza. Esta impone un particular deber de obediencia a los militares, que es resguardado, al mismo tiempo, por el derecho disciplinario militar y el derecho penal militar. Da cuenta que si bien la justicia penal militar no está prohibida por el derecho internacional de los derechos humanos, se considera una norma de aplicación restrictiva. Detalla los requisitos de validez que plantea el derecho internacional para la justicia militar, y cómo la jurisprudencia del sistema interamericano ha in fl uido en la reforma de la jurisdicción penal militar en el continente.
其他摘要：This article describes that the military right comes from the constitutional regulation of the use of force. This regulation imposes a particular duty of obedience to the military, that is guarded at the same time, by the military disciplinary right and the military penal code. It informs that although military justice is not forbidden by the international right of the Human Rights, is considered as a regulation of restricted application. Also details, the valid requisites presented by the international right for the military justice, and how jurisprudence of the Inter American system had in fl uenced the reform of the military penal jurisdiction in the continent.
