摘要：Os direitos da personalidade são direitos subjetivos da pessoa de defender o que lhe é próprio, ou seja, a sua integridade física, integridade intelectual e integridade moral. São direitos inatos e estão relacionados a atributos inerentes à condição humana, cabendo ao Estado reconhecê-los e sancioná-los em nível constitucional ou em legislação ordinária. Os direitos de personalidade subjetivos públicos, tem sua tutela resguardada pela Constituição Federal e estão relacionados diretamente ou indiretamente com o Estado, evidenciando a tutela do Estado a favor do particular através de normas constitucionais definidoras e programáticas de direitos, que estabelecem direitos fundamentais no aspecto civil, político e socioeconômico que a Constituição defere a toda pessoa humana.
其他摘要：The personality rights are the person subjective rights to defend what is its their own, in other words, its physical integrate, intellectual integrate and moral integrate. They are innate rights and they are related to inherent attributes to human condition, it is the State responsibility recognize and sanction them in constitutional level or in ordinary legislation. The public subjective personality rights have its guardianship protected by the Federal Constitution. They are direct or indirect related with the State, showing up the State guardianship in favor of particular through constitutional defining and programmatic rules of rights that establish fundamental rights in the civil politic and social economic aspects which the Constitution guarantee to all human being.
