摘要：Dentro de la actual sociedad democrática colombiana se habla de grupos históricamente discriminados y marginados que, aun siendo reconocidos dentro del Estado Social y Democrático de Derecho, sus libertades fundamentales y derechos constitucionales se encuentran severamente limitados. En este punto, se cree que es a partir de la política de acción afirmativa y de las medidas de discriminación inversa o positiva como se puede llegar a alcanzar la tan anhelada igualdad material que tanto demandan. Otrora, siendo una iniciativa de aceptación generalizada, sus dificultades se concentran en lo ineficaces que pueden llegar a ser, si se trata de deshacer ciertos imaginarios naturalizados de inferioridad que afectan a un buen número de sujetos de derecho dentro del orden legal y social. Las estructuras hegemónicas de sometimiento aquí juegan un papel fundamental para entenderlo, por lo menos aquella que indica cómo el otro, el diferente, al no adaptarse a esa noción de individuo que trajo consigo la modernidad, fue discriminado e invisibilizado. Al respecto conviene advertir: es a partir de la subjetividad como se rompe con las simplificaciones jurídicas de este tipo y se aborda con beneplácito consentimiento el tema de la reivindicación de personas, por ejemplo, que se encuentran en situación de desplazamiento o pertenecen a comunidades étnicas.
其他摘要：Within the actual Colombian democratic society it is spoken about groups that are historically discriminated and alienated that, even being recognized in the Social and Democratic State, their fundamental freedoms and constitutional rights are severely limited. At this point, it is believed that, from the politics of affirmative actions and degrees of positive or inverse discrimination, that the most longed material equality can be achieved. In other times, an initiative widely accepted, have some difficulties concentrated in how ineffective these can be, when it comes to dissolve certain naturalized imaginaries of inferiority that affect a wide number of subjects of right inside the legal and social order. The hegemonic structures of subjugation here play a fundamental role to understand it, at least those that indicates how the other, the different, by not adapting to that notion of individual that brought the modernity with itself was discriminated and hidden from reality. About this topic, it must be adverted: is from the subjectivity that legal simplifications of such kind are irrupted, and it is addressed with great consent and pleasure the topic on the acceptance of people, For example, that find themselves in situation of displacement or belong to ethnic communities.
