摘要：O presente trabalho tem como objetivo traçar algumas considerações acerca da atuação estatal perante aqueles que, sob sua custódia, iniciaram greve de fome e também discorrer sobre o direito que estes indivíduos detêm em utilizar o próprio corpo como instrumento de manifestação e protesto e os agravos à saúde provocados por esse tipo de manifestação. Para tanto, fez-se um estudo não só sobre os fundamentos que legitimam atuação estatal sobre esses indivíduos, como também sobre os fundamentos que impõe limitações a esse exercício de poder. As considerações aqui apresentadas, oriundas de pesquisas de revisão bibliográfica, permitem analisar a atuação do poder estatal frente aos direitos fundamentais do detento, que inicia greve de fome. Foi possível observar que a abstenção do Estado em intervenções no exercício do direito de livre manifestação cumpre a função de proibir ingerências na esfera jurídica individual, de forma a evitar agressões no âmbito das liberdades individuais. Constatou-se, também, que cabe ao Estado reconhecer ao súdito a capacidade jurídica de atuar em seu favor, colocando-se, aquele, na posição de garantidor dessa prestação. O limite desta são os direitos fundamentais fundada na noção da dignidade da pessoa humana. Quanto aos aspectos relacionados à saúde terão diversas causando e/ou agravando patologias existentes e tendo a idade como um fator influenciador dessa resposta.↓El presente trabajo tiene el objetivo de hacer algunas consideraciones sobre el desempeño del estado ante aquellos que, bajo su custodia, iniciaron una huelga de hambre y también discuten el derecho que tienen estos individuos al usar sus propios cuerpos como un instrumento de manifestación y protesta y al Provocado por este tipo de manifestación. Por lo tanto, se realizó un estudio no solo sobre los fundamentos que legitiman el desempeño del estado en estos individuos, sino también sobre los fundamentos que imponen limitaciones a este ejercicio de poder. Las consideraciones presentadas aquí, basadas en la revisión de la literatura, nos permiten analizar el desempeño del poder estatal en contra de los derechos fundamentales de los detenidos, quienes inician una huelga de hambre. Se pudo observar que la abstención del Estado en las intervenciones en el ejercicio del derecho de libre manifestación cumple la función de prohibir la injerencia en la esfera jurídica individual, para evitar agresiones en el ámbito de las libertades individuales. También se determinó que corresponde al Estado reconocer al sujeto la capacidad legal para actuar a su favor, colocándolo en la posición de garante de ese beneficio. El límite de esto son los derechos fundamentales fundados en la noción de la dignidad de la persona humana. En cuanto a los aspectos relacionados con la salud, habrá varias patologías causantes y / o agravantes existentes y la edad como factor influyente de esta respuesta.
其他摘要：The present work has the objective of drawing some considerations about the state performance before those who, under its custody, started a hunger strike and also discuss the right that these individuals have in using their own bodies as an instrument of manifestation and protest and the caused by this type of manifestation. Therefore, a study was made not only on the foundations that legitimize state performance on these individuals, but also on the foundations that impose limitations to this exercise of power. The considerations presented here, based on literature review, allow us to analyze the performance of the state power against the fundamental rights of the detainee, who initiates a hunger strike. It was possible to observe that the abstention of the State in interventions in the exercise of the right of free manifestation fulfills the function of prohibiting interference in the individual juridical sphere, in order to avoid aggressions within the scope of individual freedoms. It was also found that it is for the State to recognize the subject the legal capacity to act in his favor, placing him, in the position of guarantor of that benefit. The limit of this is the fundamental rights founded on the notion of the dignity of the human person. As for the aspects related to health will have several causing and / or aggravating existing pathologies and taking the age as an influencing factor of this response.
