摘要：O texto trabalha com uma interseção entre o novo realismo na vertente especulativa e a teoria do direito. Partindo da concepção de uma arrogância epistemológica e do conservadorismo epistemológico, é preciso sair da correlação entre o ser e o pensar para permitir que o direito adquira novos sentidos para além da subjetividade e da arbitrariedade que lhe é inerente. Ademais, a contingência do direito e o Grande Afora coloca por terra a busca pela essência, pela natureza, pelo conceito ou pelo o que é o direito. Pergunta que moveu toda a teoria do direito do século XX e XXI.

Starting from the conception of epistemological arrogance and epistemological conservatism; it is necessary to get out of the correlation between being and thinking to allow the law to acquire new meanings beyond subjectivity and the arbitrariness inherent in it.
