摘要：En este trabajo se reflexiona sobre el momento en el que se encuentran actualmente los derechos sociales. Para ello se discuten algunos de los argumentos que se suelen utilizar para diferenciar estos derechos de los civiles y políticos.A partir de ahí se señala que uno de sus rasgos distintivos es su voluntad de detraer del mercado la satisfacción de las necesidades más básicas. En el momento actual, el mercado laboral no sirve como garantía de un gran número de derechos sociales por ello su futuro pasa por buscar nuevas garantías a losderechos, tanto primarias como secundarias o jurisdiccionales.
其他摘要：This paper reflects about the present situation of social rights especially in western countries. With this aim, some of the arguments used to distinguish civil and social rights are discussed. One of the characteristics of social rights is their purpose of taking out of the market the satisfaction of the most basic needs. In the present context, labor market is not a good guarantee to social rights; in consequence, the future of social rights will consist in looking for new primaryand secondary guarantees to them.
