摘要：Los principios en el ámbito del Derecho han sido esgrimidos en defensa de disímiles posturas teóricas y prácticas. El presente artículo, se dedica al enfoque de los principios desde una nueva perspectiva, la derivada de la actuación de los jueces o magistrados en el desempeño de una de las más importantes funciones del Estado, la de impartir justicia. Aun cuando la corrupción judicial es un fenómeno delictivo multicausal y no es posible en estas líneas abarcar la nocividad que ello representa para cualquier sistema social, dentro de las causales que pudieran provocarla o incentivarla se encuentra el comportamiento incorrecto o la actuación indebida de los jueces. De ahí surge la necesidad de que estas personas cumplan y hagan cumplir las leyes sobre la base de estos principios básicos para garantizar la transparencia de la función jurisdiccional. Los reglamentos, estatutos, códigos que norman o regulan la actividad judicial deben estar regidos por los principios que aquí se postulan, en caso contrario, existe un riesgo de corrupción. Por todo ello se pretende incentivar a través de este artículo, la correcta actuación judicial para contribuir a la prevención de la corrupción en esta esfera de la vida social. The present article, is dedicated to the approach of the principles from a new perspective, the derivative of the performance of judges or judges in the performance of one of the most important functions of the State, the impart justice. Even though judicial corruption is a multicausal criminal phenomenon and it is not possible in these lines to cover the harmful effects that this represents to any social system, within the grounds that could cause or encourage her behavior is incorrect or improper performance of the judges. Hence, it is necessary that these people meet and enforce the laws on the basis of these basic principles to ensure the transparency of the judicial function. Regulations, statutes, codes that norm or regulate judicial activity should be governed by the principles that are here postulated, otherwise, there is a risk of corruption. This is intended to encourage through this article, the proper judicial action to contribute to the prevention of corruption in this sphere of social life.
