摘要：A pesar del extraordinario auge de la técnica de la ponderación de derechos en la jurisprudencia y en la doctrina, la relación entre el abuso del derecho y la ponderación apenas ha sido analizada. Esta nota tiene por objeto realizar una primera aproximación a esta relación, con el fin de delimitar los contornos y puntos de fricción entre ambos fenómenos.
其他摘要：Despite the extraordinary rise in the method of balancing of rights both in the case-law and scholarship, the relationship between the abuse of rights and the balancing has barely been analyzed. This note aims to make a first approach to this relationship, in order to delimit the contours and points of friction between these two phenomena.
