摘要：El trabajo se divide en tres partes. En la primera se muestra por qué es equivocada la caracterización que Ferrajoli hace del constitucionalismo al que llama «principialista» o «argumentativo». En la segunda se aclara qué es lo que esa concepción del Derecho (a la que el autor prefiere denominar «postpositivismo») realmente sostiene. Y en la tercera se señalan cuáles son las tesis que Ferrajoli (el constitucionalismo «normativista») debería abandonar para poder cumplir con los objetivos que él mismo plantea para la teoría del Derecho.

In the first, the author shows why the characterization that Ferrajoli presents of the kind of constitutionalism that he calls «principialist» or «argumentative» is wrong. In the second, the nature of this last conception (that the author prefers to denominate as «postpositivist») is clarified. Lastly, the author identifies the thesis that Ferrajoli’s «normativist» constitutionalism should abandon in order to achieve the aims that Ferrajoli himself attributes to a theory of law.
