摘要:Purpose – To establish a relationship between the government acquisition process and the Responsive Regulation Theories of Jonathan Kolieb and Capture Theories of George Stigler and David Martimort. Methodology/approach/design – Bibliographical review of the aforementioned authors and empirical findings in a database of Brazilian federal government systems: National Registry of Inertial and Suspended Companies System (CEIS); and the Companies Registry System (SICAF). Findings – Despite evident differences between the government acquisition process and regulation, the responsive model of Kolieb and some aspects of the capture theory may contribute to avoid pitfalls in the government acquisition process. Practical implications – Renewal proposals for the current government acquisition process model, which has proven to be extremely vulnerable to acts of corruption and with great potential for harmfulness to market stability.↓Propósito – Estabelecer relação entre o ambiente das contratações públicas, sob a perspectiva de seus problemas, e as Teorias da Regulação Responsiva, de Jonathan Kolieb, e Teorias da Captura, de George Stigler e David Martimort. Metodologia/abordagem/design – Revisão bibliográfica de obras dos teóricos mencionados e constatações empíricas em base de dados de sistemas do governo federal, em especial o Cadastro Nacional de Empresas Inidôneas e Suspensas (CEIS) e do Sistema de Cadastro de Fornecedores (SICAF). Resultados – apesar das dessemelhanças entre o ambiente das contratações públicas e o regulatório, o modelo da regulação de Kolieb e alguns aspectos da teoria da captura podem colaborar na solução de alguns problemas das contratações públicas. Implicações práticas – Propostas de renovação do modelo atual de contratações públicas, que tem se mostrado extremamente vulnerável a atos de corrupção e com potencial de nocividade à estabilidade do mercado.
