  • 摘要:Purpose – This paper aims to present the Brazilian model of public service concessions and regulatory agencies, as well as to analyze how the new regulatory framework of the port sector fits in this model. Methodology/approach/design – The method of approach is the inductive one and through literature reviewing. It is a qualitative research based on the administrative process theory of regulation. Findings – The results suggest that the new regulatory framework of the port sector follows the rules of the concession model and regulatory agencies, despite having unique characteristics. It was also found that the port legal framework provides conditions for a regulatory oriented production to meet the public interest. Practical implications – This study provides a better understanding of the relationship, not always clear, between the model of public service concession and rendering port-associated services. There are also relevant practical issues concerning the identification of differences between the port sector and the traditional model of concessions and the possibility of regulatory-oriented production to meet the public interest.↓Propósito – Este artigo visa apresentar o modelo brasileiro de concessão de serviços públicos e de agências reguladoras, bem como analisar de que forma o novo marco regulatório do setor portuário está inserido nesse modelo. Metodologia/abordagem/design – O método de abordagem é o indutivo e a técnica para obtenção de dados é a pesquisa bibliográfica, com base em documentação indireta. A pesquisa foi de caráter qualitativo e teve como base a teoria processual administrativa da Regulação. Resultados – Os resultados sugerem que o novo marco regulatório do setor portuário segue as regras de exploração do modelo de concessões e de agências reguladoras, apesar de possuir características singulares. Constatou-se, ainda, que o marco legal portuário fornece condições para uma produção regulatória orientada à satisfação do interesse público. Implicações práticas – O artigo possibilita um melhor entendimento acerca da relação, nem sempre clara, entre o modelo de concessões de serviços públicos e a exploração do setor portuário. Também são questões práticas relevantes a identificação de diferenças entre o setor portuário e o modelo tradicional de concessões e a possibilidade de produção regulatória no setor voltada ao interesse público.
