摘要：A proposta cinge-se na questão do modo em que a Avaliação de Impacto Regulatório pode se fundamentar juridicamente para encontrar validade para sua utilização em território pátrio. Um dos mecanismos amplamente utilizados para fomentar a regulação é a Avaliação do Impacto Regulatório (AIR) como condição do processo decisivo, e criação de um novo plano a ser utilizado por agentes reguladores. A presente pesquisa, pautada do método indutivo, com o propósito de alcançar objetivos que enveredam na relevância da utilização da Avaliação de Impacto Regulatório (AIR), foi realizada no modelo qualitativo, com levantamento de dados e análise dos entes regulatórios.
其他摘要：The aim of this paper is concerned with the question of how the Regulatory Impact Assessment can be based legally to find validity for its use at homeland. One of the mechanisms widely used to foster regulation is Regulatory Impact Assessment (RIA) as a condition of the decisive process, and creation of a new plan to be used by regulators agents. The present research, guided by the inductive method, and to achieve its objectives, that is, the relevance of the use of the Regulatory Impact Assessment (RIA), was carried out qualitative research with data collection and analysis of regulatory agencies.
