摘要：O presente estudo analisa a representação do magistrado construída por Luísa Carlos Martins Pena (1815-1848) em O juiz de paz na roça (1833), de modo a (re)contextualizar o lugar do direito e da Constituição e o papel da magistratura durante o Império. A partir da curta peça teatral, torna-se possível traçar de forma nítida as tensões que marcam essa época, notadamente a tensão paradoxal entre absolutismo e liberalismo na Constituição Imperial de 1824. Além disso, a literatura torna-se instrumento capaz para que sejam realizadas críticas à estrutura social, política e jurídica do período, expondo ( i ) a débil formação jurídica do Brasil do século XIX; ( ii ) a corrupção sistêmica e oficializada da nascente magistratura nacional; ( iii ) o desprezo do povo à Constituição e ao direito; ( iv ) e, por fim, os traços distintivos do que é comumente chamado de constitucionalismo imperial . Essa abordagem interdisciplinar está inserida na tradição do direito e literatura, mais especificamente na corrente do direito na literatura (Richard Posner) e sob a perspectiva dos modelos de juiz (François Ost). ABSTRACT Based on the theoretical and methodological contributions of Law and Literature studies, this article analyzes the representation of the judge in the work O juiz de paz na roça [The justice of peace in the countryside], written in 1833 by Luis Carlos Martins Pena (1815-1848), in order to identify the place of the Constitution and the role of the judiciary during the imperial period. This theater piece describes the tensions of the time and, above all, the paradox observed in the 1824 Charter between absolutism and liberalism. Thus, literature emerges as a powerful ally for both the construction of national identity and for the understanding of social reality, revealing (a) the weak legal formation of nineteenth-century Brazil, (b) the systemic and official corruption of the nascent judicial power, (c) the lack of knowledge of common people on the constitution and of law in general, and, finally, (d) the distinctive features of what is commonly called imperial constitutionalism.
