摘要：Sektor pasar modal merupakan salah satu sektor jasa keuangan yang memegang peranan penting dalam pembangunan nasional. Kondisi pada saat ini, terdapat banyak kritik terhadap penyelesaian sengketa di pasar modal yang disebabkan banyak faktor terkait penegakan hukum, sehingga upaya menciptakan pasar modal yang teratur wajar dan efisien belum tercapai optimal. Penyelesaian sengketa melalui pengadilan negeri masih jarang ditemukan, padahal salah satu lembaga peradilan yang berperan dalam penegakan hukum adalah pengadilan negeri. Penulisan ini berdasarkan suatu penelitian yuridis normatif yaitu penelitian hukum terhadap asas-asas hukum, peraturan hukum serta perbandingan hukum inventarisasi hukum positif, dengan metode pendekatan deskriptif analisis. Penarikan simpulan dari hasil penelitian yang telah terkumpul dilakukan dengan metode analisis normatif kualitatif. Hasil penulisan dalam artikel ini menguraikan mengenai peranan pengadilan negeri dalam penyelesaian sengketa pasar modal dalam praktik dan peranan penyelesaian sengketa melalui pengadilan negeri terhadap penegakan hukum pasar modal di Indonesia.
其他摘要：The capital market sector is one of the financial services sectors that play an
important role in national development. At present, there are many criticisms of
capital market dispute resolution caused by many factors related to law enforcement,
so that efforts to create an orderly and efficient capital market have not been
optimally achieved. Dispute resolution through a district court is still rarely found,
even though one of the judicial institutions that play a role in law enforcement is a
district court. This writing based on normative juridical research, namely legal
research on legal principles, legal regulations and the comparison of positive law
inventory law, with a descriptive analysis approach. Withdrawal of conclusions from
the results of research that has been collected is done by the method of qualitative
normative analysis. Writing in this article will outline the role of the district court in
the settlement of capital market disputes in practice and how the role of dispute
resolution through the district court over the enforcement of capital market law in
Indonesia.
