摘要：La Ley de Justicia y Paz, conllevó acciones concretas de desmovilización, de esclarecimiento de verdades, de reparación de víctimas y de concreción de una forma diferencial de justicia para hacer frente a las complejidades de esta propuesta. Por primera vez, en la historia de los procesos de paz en Colombia, las víctimas tuvieron un papel protagónico y se hicieron ajustes en el Estado y la legislación, para garantizar su atención y reparación. Este trabajo se enfocó en el derecho que tienen las víctimas del conflicto armado colombiano a ser resarcidas por sus victimarios. Con base en el análisis de la jurisprudencia producida por los distintos procesos, los informes de la unidad de víctimas y los documentos que la fiscalía y el Grupo de Memoria Histórica han ido recopilando, así como la experiencia que el campo laboral ha brindado, se analiza cómo se ha llevado a cabo esta reparación en el marco de dicha ley y que retos implica para el derecho y el aparato estatal. Señalando las falencias, se busca proyectar una luz sobre lo que puede suceder en el desarrollo del proceso de paz que se implementa con las FARC y en el futuro de otros procesos similares en la nación.
其他摘要：The Justice and Peace Law brought concrete demobilization actions, the seeking of truths, the reparation
of victims and the establishment of a differential way of justice as ways of facing the complexities of the proposal. For the first time in Colombia’s peace process history did the victims play an important role,
making adjustments to the state and legislation guaranteeing their attention and reparation. This work
focused on the rights victims of the armed conflict have to be compensated by their victimizers. Based
on the analysis of the jurisprudence produced by the different processes, the report from the victims
unit, from prosecution documents, and other documents the Historical Memory Group has compiled,
as well as the experience gained from the work field, the way reparation is carried out is analyzed within
this law’s framework, identifying the challenges not only for other laws but for the state. By identifying
the flaws, it is hoped to shed some light into what could happen during the development of the peace
process with the FARC and other peace processes in the country.
