Kemudian dirubah dengan Peraturan Menteri Perdagangan No . 57 Tahun 2010 yang kemudian diperbaharui dengan Peraturan Menteri Perdagangan No . 83 Tahun 2012,belum menciptakan kesejahteraan masyarakat perbatasan s ebagaimana yang diharapkan, karena penutupan tersebut membuat sebagian besar masyarakat kehilangan pendapatan dan pekerjaan mereka. Bahwa model regulasi perdagangan lintas batas yang tepat bagi akses keadilan dan kesejahteraan masyarakat adalah regulasi yang baik secara teori memenuhi unsur-unsur formil dan materiil, dan regulasi yang mampu pula memasukkan unsur kepentingan masyarakat .
