摘要：Este artículo tiene como objetivo determinar el papel epistémico de la verdad en la construcción de teorías en la ciencia del Derecho, a partir de la necesidad de explicar el carácter racional y razonable que deben tener las razones con las que se estructura un discurso científico. Germán Sucar, en Naturaleza del Derecho y la verdad jurídica , ubica un punto de partida epistémico para dicha construcción, cuyo propósito es ofrecer un plano limitado en el que confluyen algunos elementos inexcusables para la construcción de una teoría en general y en particular, para la ciencia del Derecho. Para respaldar esta tesis y cumplir con el objetivo planteado, nos hemos centrado en la obra de Robert Brandom, fiel a la teoría inferencialista que provee los elementos epistémicos necesarios para comprender cómo justificar una teoría en los límites del lenguaje y de las características de racionalidad y razonabilidad; y de Hans-Georg Gadamer, fiel a la teoría hermenéutica que respalda la cercanía entre lenguaje y verdad como epistemología, dentro del conjunto racional/razonable. Este texto se divide en cinco partes. En un primero momento, se plantea el problema de la verdad y cómo ha sido tratado desde diferentes construcciones teóricas. En este apartado, hacemos énfasis en las teorías pro-oracionales y las teorías hermenéuticas de la verdad. Segundo, apoyadas en la manifiesta cercanía del pensamiento de Gadamer y el de Brandom, hacemos frente al problema de si en el pensamiento de estos dos filósofos hay una teoría de la verdad, esto es, qué estatus epistémico tienen las ideas de estos pensadores acerca de la verdad para la construcción de una teoría en la ciencia del Derecho. Tercero, se presenta el concepto de verdad en el pensamiento de Gadamer. Cuarto, se presenta el concepto de verdad en el pensamiento de Brandom. Por último, se responde al problema que guía esta investigación centrándonos en las convergencias que tiene el pensamiento pragmatista frente al hermenéutico.
其他摘要：The objective of this article is to determine the epistemic role of truth in the
construction of theories in the science of Law, based on the need to explain
the rational and reasonable nature of the reasons for structuring a scientific
discourse. Germán Sucar, in Nature of Law and Legal Truth, locates an
epistemic starting point for such construction, whose purpose is to offer a
limited plane in which some inexcusable elements converge for the
construction of a theory in general and in particular, for the science of Law.
To support this thesis and meet the stated objective, we have focused on the
work of Robert Brandom, faithful to the inferential theory that provides the
necessary epistemic elements to understand how to justify a theory on the
limits of language and characteristics of rationality and reasonableness; and
of Hans-Georg Gadamer, faithful to the hermeneutic theory that supports the
closeness between language and truth as epistemology, within the rational /
reasonable set. This text is divided into five parts. At first, the problem of
truth arises and how it has been treated from different theoretical
constructions. In this section, we emphasize pro-orational theories and
hermeneutic theories of truth. Second, supported by the evident closeness of
the thought of Gadamer and Brandom, we face the problem of whether in the
thinking of these two philosophers there is a theory of truth, that is, what
epistemic status the ideas of these thinkers have about the truth for the
construction of a theory in the science of Law. Third, the concept of truth is
presented in Gadamer's thought. Fourth, the concept of truth in Brandom's
thinking is presented. Finally, the problem that guides this research is
addressed by focusing on the convergences that pragmatist thinking has
over the hermeneutic.
