摘要：Este artigo tem como objetivo demonstrar que a culpabilização das vítimas de crimes sexuais não se restringe à simples subsunção legal da relação vítima-agressor, porquanto transcorre de ideologias, consubstanciadas nos discursos de hierarquização de gênero presentes em determinada sociedade. Assim, pretende-se evidenciar a influência dos padrões crença e valor na estigmatização das vítimas de crimes sexuais e a insuficiência do sistema punitivo, verificada, principalmente, nos processos de vitimização, produzidos pelas instâncias de controle social, para resolver a questão cultural inerente a este tipo de criminalidade. Diante da complexidade da abordagem, utilizou-se o método dialético.
其他摘要：This article aims to demonstrate that the culpabilization of the victims of sexual crimes is not restricted to the simple legal subsumption of the victim-aggressor relationship, since it runs from ideologies, embodied in the gender hierarchical discourses present in a given society. Thus, it is intended to highlight the influence of belief and value standards on the stigmatization of victims of sexual crimes and the insufficiency of the punitive system, mainly verified in victimization processes, produced by social control instances, to solve the cultural issue inherent in this kind of crime. In view of the complexity of the approach,, the dialectical method was used.
