摘要：Este artículo analiza un ámbito fundamental de la política pública de migración y retorno en Colombia: la Ley 1565 de 2012, focalizándose en dos importantes elementos: 1) la tipologización del retorno y 2) sus incentivos. Se combina el análisis crítico del texto legal con los relatos extraídos de entrevistas y grupos focales realizados en Colombia y Ecuador. Se plantea a manera de conclusión que el discurso legal opera en dos vías: por un lado, invisibiliza a los retornados más frágiles y vulnerables, clasificándolos en categorías que carecen de fundamento empírico; y, por otro, hay una invención del sujeto retornado, como un sujeto con capacidades desarrolladas, listo para aplicar a los incentivos económicos ofrecidos. De esta manera, se sostiene que dichas políticas conciben el proceso migratorio como un simple desplazamiento geográfico, y no como un derecho humano, lo cual adquiere particular importancia en el actual contexto del país.
其他摘要：This article analyzes a fundamental area of the public policy of migration and return in Colombia: Law 1565 (2012). It focuses on two important elements: the typologization of return, and the incentives and deadlines to implement the law. The critical analysis of the legal text is combined with stories extracted from interviews and focus groups carried out in Colombia and Ecuador. It is concluded that legal discourse operates in two ways: on the one hand, it makes invisible the most fragile and vulnerable returnees, classifying them into categories that lack an empirical foundation; and, on the other hand, there is an invention of the remigrated as a subject with developed abilities, ready to be applied to the economic incentives offered. In this way, it is argued that these policies conceive the migratory process as a simple geographic displacement, and not as a human right, which becomes particularly important in the current context of the country.
