摘要：The current Penal Code used today was originated from “Wetboek van Strafrecht voor NederlandshIndie” in 1981,which was started to be officially used in Indonesia based on Act nomor 1 of 1946 juncto Act nomor 73 of 1958. Considering the old use of the penal code,some provisions are indeed obsolete. Therefore,it must be amended in order to accomodate the rapid development of science and the change in the society. There had been an effort to make a comprehensive amendment by proposing Penal Code Draft. However,it has not been ratified until now. This condition creates partial modifications in the penal code strated from Goverment Regulation number16 of 1960 to Supreme Court Regulation number 2 of 2012 about the adjustment of petty crime boundary and the fine in the penal code. Furthermore,not all changes made in the penal code are based on the amendment procedure. Some changes are made without following the appropriate amendment procedure.
