摘要：This study aims to find,analyze and provide an evaluation of the concept of separation of property in marriage based on Maslahah Mursalah perspective. Couples often make prenuptial agreements that contain separation of property before the marriage ceremony. In fact,there are husband and wife who separates his property after the marriage took place. This is a normative research using legal and conceptual approach. The result shows that the concept of separation of property in marriage has been in accordance with masalahah mursalah,where the concept of separation of property is a form of protection of the soul and property of married couples.
