摘要：Verslo perdavimo konstatavimas – verslo perdavimą nusakančių požymių įvairiapusės analizės rezultatas. Tiek verslo perdavimą leidžiančių identifikuoti požymių kiekis,tiek jų turinio aiškinimas nuolat kinta dėl besivystančios Teisingumo Teismo praktikos. Verslo perdavimą nusakančių požymių svarumas ir nustatymo sudėtingumas kiekvienu konkrečiu atveju yra skirtingas. Tačiau daugiausia dėmesio skiriama perduodamo verslo „tapatumui“ nustatyti. Straipsnyje analizuojama tapatumo požymio kilmė,reikšmė,aiškinama jo samprata ir turinys.
其他摘要：Establishment of a business transfer is a result of a comprehensive analysis of the features that identify business transfer. Both a number and a scope of those features are in a process of constant change due to the case law developed by the Court of Justice. The weight of such features in every particular situation is different,as well as the complexity of their identification. However,the crucial focus should be made on the establishment of “identity” of the transferred economic entity. This article discusses the origin,significance,conception and contents of the feature of identity.
