其他摘要：The Economic Analysis of Law, school of interdisciplinary study developed mainly
in the United States, faces a peculiar situation in Brazil: it is seen by some as unique and
superior tool to understand the Law, while it is repelled by others. In the core of this matter,
there is a considerable ignorance by the Brazilian doctrine about the economic postulates,
partly due to the lack of criticality and epistemological reflexion by those who study it in the
country. A critical review of the method and the historical of the school shows that there are
some possible uses of the economical method in Brazilian Law with positive contributions to
lawyers, economists and society, once the due adaptations to the Brazilian legal order and
constitucionalism are made.
